A plastic surgeon based in Southern California has been ordered to cease his practice after testing positive for alcohol on three occasions within a 10-day timeframe while on probation.
Dr. Abhay Gupta, who operates clinics in San Diego and Encinitas, had his medical license revoked in 2022 but was allowed to continue working under strict conditions for five years.
Gupta runs his own practice at Gupta Plastic Surgery, where he reportedly conducts “100% of all surgeries, BOTOX, injections, and laser treatments,” as stated on his website.
“He is exceptionally skilled in breast reconstruction, revision surgery, and complex aesthetic cases,” it mentions.
In 2019, Gupta was arrested and pled guilty to a DUI. Subsequent formal accusations led the Medical Board of California to revoke his medical license while imposing a five-year probation.
One condition of his probation was to “abstain from the use of alcohol” and undergo “biological fluid testing.”
However, Gupta failed three biological fluid tests this year, again testing positive for alcohol on three separate occasions in 2024.
“These disciplinary actions have spanned four, five, and six years. How many patients have been affected by this? We may never know,” remarked Michele Monserratt-Ramos, a patient advocate at Consumer Watchdog and proponent of improved patient protections, in an interview with ABC10.
